Can You Keep Your Job? FMLA and Going to Treatment
Published Mar 7, 2026 · Updated Jul 8, 2026
Fear of losing a job keeps many people from getting help. The good news: federal and workplace protections often let you get treatment and keep your job.
What FMLA covers
The Family and Medical Leave Act (FMLA) can provide eligible employees up to 12 weeks of unpaid, job-protected leave for a serious health condition — which can include treatment for a substance use disorder. Your role (or an equivalent one) is protected while you're out.
Eligibility basics
Generally you must have worked for a covered employer for at least a year and 1,250 hours. Many employers also have Employee Assistance Programs (EAPs) that support treatment confidentially.
Privacy at work
You're not required to share medical details with your employer, and your treatment is protected under HIPAA. You control who knows what.
We'll help you plan
We can time treatment around your work situation and help you understand your options. Your career and your recovery don't have to be in conflict.
